1. Acceptance of Terms

By accessing or using dreamfactorystudio.org or the Creative Portal at app.dreamfactorystudio.org (together, the “Site”), you agree to these Terms of Use. If you do not agree, please do not use the Site.

2. About DFSS

Dream Factory Sound Sanctuary (“DFSS,” “we,” “us”) is a 501(c)(3) nonprofit organization located in San Diego County, California. We provide artist residencies, recording facilities, educational programs, and related creative services in support of our charitable mission.

3. Use of the Site

You may use the Site for lawful purposes only. You agree not to misuse the Site, interfere with its operation, attempt to gain unauthorized access to any systems or accounts, or use the Site to violate any applicable law.

4. Accounts

Some features of the Creative Portal require an account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that violate these Terms.

5. Residency Applications and Fees

Artist residency applications are submitted through forms on the Site and may require a non-refundable application fee. Submitting an application does not guarantee acceptance. Residency participation is subject to separate agreements, including liability waivers and media consent, provided at the time of acceptance.

6. Donations

Donations to DFSS are processed through our third-party payment partner, Zeffy, and are tax-deductible to the extent allowed by law. DFSS retains full discretion over the use of all donated funds. While we honor the intent of designated gifts wherever possible, we may reallocate funds to similar charitable purposes if circumstances change. Donations are non-refundable except as required by law.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, and the DFSS name and winged-heart mark — is owned by or licensed to DFSS and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission. Content you submit to the Site remains yours, but you grant DFSS a non-exclusive license to use it as necessary to operate the Site and fulfill our mission.

8. Third-Party Services and Links

The Site uses and links to third-party services (including Jotform, Zeffy, Supabase, Google, Resend, and Vercel) and may link to external websites. We are not responsible for the content, policies, or practices of any third party. Your use of those services is governed by their own terms and privacy policies.

9. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, DFSS and its officers, directors, volunteers, and agents will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in San Diego County, California.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page, and your continued use of the Site constitutes acceptance of the updated Terms.
